With the passage of Proposition 64, the Adult Use of Marijuana Act, California left it up to local cities and counties to decide who gets to do what, where, and how. The result: a complex and at times confusing regulatory program for recreational use of cannabis. And to complicate the issue, California is at odds with Federal law which is clear: Marijuana is a Schedule 1 drug, on par with heroin, which makes it illegal to possess, grow, transport.

As a commercial property owner, property manager, contractor, broker, and potential recreational user, while there appears to be money to be made, is it worth the risks? Can the Feds seize your property? Arrest you?

Call your loan? What are the issues to consider if a dispensary or grow warehouse wants to lease your building?  What do you do when your tenants give you a bag of money?

To help you sort through this legal and regulatory maze, we have assembled a panel of experts to present their thoughts and to answer your questions about the “Greening of California”: Holy Smokes!!! It’s Legal, Now What?"

Aaron Flynn, co-founder and a managing partner of Gold Seal San Francisco. a cultivation company that also provides packaging and distribution services to other Bay Area cannabis companies. Aaron sits on the State board of the California Growers Association in Sacramento and is a founder and the Chair of the San Francisco Chapter of the California Growers Association.

Dona Frank, founder at Organicann, Oakland Organics, Suspiciously Delicious, AGE, ShopMarijuana.com, The Natural Cannabis Company

Nicole Howell Neubert, a partner of Clark Neubert LLP.  She has advised hundreds of cannabis operators on the California’s market.  Nicole serves as Chief Policy Advisor to the California Growers Association, on the Board of California NORML, and is involved in other industry-related organizations, including the National and California Cannabis Industry Associations, and the National Cannabis Bar Association. 

Carlos Serrano Quan, the Managing Director of Verakin Real Estate. Since 2004, Carlos has helped his private clients with complex commercial real estate transactions, specializing in the Cannabis Industry San Francisco Bay Area, representing Landlords and Tenants.

Marshall  Nehring, Vice President at Heffernan Insurance Broker, focused on association programs in the cannabis industry.
